Terms & Conditions
By using lazarogold.com (the "Site") or selling precious-metal items to us through mail-in, video call, or in-person evaluation (the "Services"), you agree to these Terms & Conditions. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and the lawful owner of the items you submit, with full right to sell them. By using the Services, you represent that the items are not stolen, encumbered, or subject to any third-party claim.
2. The process
- Request. You request a free evaluation kit, book a video call, or schedule an in-person visit.
- Submit. For mail-in, you ship your items using the prepaid, insured label we provide. For video or in-person, we evaluate your items live.
- Evaluation. We test purity using methods such as XRF (X-ray fluorescence) and acid testing, and weigh items on a calibrated scale.
- Offer. We send you a no-obligation offer based on the fine-gold content and the market (spot) price (see our Pricing Disclaimer).
- Payment or return. If you accept, we pay you by your chosen method. If you decline, we return your items free of charge.
3. Preliminary estimates are not offers
Any figure produced by our online calculator or quiz, or stated during a video call before physical inspection, is a preliminary estimate only, based on the information you provide. It is not a binding offer. The binding offer is the written final offer we issue after physically inspecting, testing, and weighing your items.
4. Free kit, shipping, insurance, and returns
We provide the evaluation kit, prepaid and insured shipping, and free returns at no cost to you. Shipment is insured up to the limit stated in your kit materials. PO Box addresses cannot be used for kit delivery for insurance and shipping reasons. Risk of loss in transit is covered by the applicable shipping insurance, subject to the carrier's and insurer's terms.
5. Offers and acceptance
Offers are valid for the period stated in the offer. Spot prices change continuously; if you do not accept within the stated window, we may re-quote at the then-current spot price. Once you accept, the transaction is final and binding.
6. Payment
We pay accepted offers via PayPal, Venmo, or Zelle, or another method we agree to. Timing depends on the provider; some methods are same-day and others take additional business days. You are responsible for providing accurate payout details. We are not liable for delays or losses caused by incorrect information you provide.
7. Highest-price guarantee
If you provide a verified, official written offer from a competitor that includes the weight, purity, and total amount for the same items, dated within 7 days, we will match or beat it, subject to verification. Details and limits are stated at lazarogold.com/guarantee or available on request.
8. Resale bonus
For eligible items, you may opt into our resale program. If an item you sold is later resold to a new owner, you receive an additional payment equal to 10% of the resale profit, paid after the resale completes. Not all items qualify, and a second payment is not guaranteed.
9. Items we accept and ownership
We buy gold and other precious-metal items as described on the Site. We do not remove or return gemstones unless expressly agreed in writing. You warrant that you own the items free and clear and that submitting them does not violate any law or third-party right. Title transfers to us upon your acceptance of the final offer and our payment.
10. Identity verification and AML
We are required to verify customer identity and maintain records under applicable anti-money-laundering and precious-metals dealer laws. We may request a government-issued ID and other information and may decline or delay a transaction to comply with these obligations. See our AML Policy.
11. No professional advice
Information on the Site is for general purposes only and is not financial, tax, or investment advice.
12. Disclaimers and limitation of liability
The Services and Site are provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, our total liability arising out of or relating to the Services is limited to the amount of the offer for the items at issue. We are not liable for indirect, incidental, or consequential damages.
13. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms or your sale of items you did not own or had no right to sell.
14. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state or federal courts located in Miami-Dade County, Florida, unless otherwise required by law.
15. Changes
We may update these Terms at any time. The "Effective date" reflects the current version, and continued use of the Services constitutes acceptance.
16. SMS/text messaging program
When you submit a request form on lazarogold.com and check the consent box, you opt in to receive recurring transactional and marketing text messages (SMS) from Lazaro Davinchy about your evaluation kit, tracking, appointments, offers, and payouts. Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of any purchase or sale.
